Explanation:

Ener-G Combined Power Limited designed, manufactured and installed all 3 CHP units at HMP Low Moss. They have also carried out all maintenance since installation in 2011.

The design of the CHP units is bespoke to Ener-G Combined Power Limited and the software that is integral to remote monitoring and fault diagnosis was developed by and is proprietary to Ener-G Combined Power Limited.

Due to the ownership of the Intellectual Property Rights of the software, it is understood that there are no organisations licensed or authorised by Ener-G Combined Power Limited to access and operate the software. The CHP units also contain a number of parts that have been modified by Ener-G and are not Original Equipment Manufacturer (OEM) parts. This means that such items are not generally and readily available in the market.

As evidence of the lack of competition, following a previous OJEU open tender exercise only 1 tender submission was received by the SPS, from Ener-G Combined Power Limited.
