III.1)Conditions for participation

List and brief description of selection criteria:

(1) All candidates will be required to provide a statement, covering the 3 previous financial years including the overall turnover of the candidate in respect of the activities which are of a similar type to the subject matter of this notice.

(2) All Candidates will be required to provide statements of accounts or extracts relating to their business.

See contract/tender documentation which incorporates the requirements of the ESPD (Scotland) and the financial period of reporting is the previous 3 financial years.

III.1.3)Technical and professional ability
List and brief description of selection criteria:

1) Confirm possession of CE Marked accreditation for all lots tendered.

2) All products tendered for are Latex Free in lots that are tendered for.

3) All products are sterile in Lot that are tendered for.

4) All products are single use for lots that are tendered for.

5) Must confirm possession of ISO 13485:2003 certification and valid for the duration of the framework.

Minimum level(s) of standards possibly required:

1) Lot One (1) - Ported PVC Safety - Must be able to tender for the core lines which are 14g, 16g, 18g, 20g and 22g.

2) Lot Two (2) - Non Ported PVC Safety - Must be able to tender for the core lines which are 18g, 20g and 22g.

3) Lot Three (3) - Ported PVC Safety Must be able to tender for the core lines which are 24g.

4) Lot Four (4) - Non Ported PVC Safety - Must be able to tender for the core lines which are 24g.

5) Lot Five (5) - Ported PVC's - Must be able to tender for the core lines which are 14g, 16, 18g, 20g and 22g.

6) Lot Six (6) - Non-Ported PVC's - Must be able to tender for the core lines which are 20g and 22g.

7) Lot Seven (7) - Non-Ported PVC - Must be able to tender for the core lines which are 24g and 26g.

8) Lot Eight (8) - Luer Lock Syringes - Must be able to tender for the core lines which are 5ml, 10ml, 20ml, 30ml and 50ml (graduated to 60ml).

9) All Lots - Must confirm that all products tendered for contain batch/lot codes and expiry dates on the lowest sales unit configuration.

10) Samples - All Lots Must confirm that samples are to be provided at the suppliers expense to the nominated participating site.

11) Reference sites - For Each Lot Suppliers must confirm that your organisation can provide three clinical references, for each lot tendered for, from three separate acute sites testifying to usage of named brand tendered herein within the last 12 months.

12) Pricing - All Lots Suppliers must confirm contract pricing must be fixed for the first two (2) years from and after the date of the letter of award issued by the Authority to all successful Framework Participants.

13) Delivery - Lead Time - All Lots Suppliers must confirm that your organisation will maintain 30 days stock holding based on NHS Scotland recurring demand and that delivery will be made within 5 working days of order placement.

14) Should an awarded supplier experience multiple supply issues, not as a consequence of force majeure, through the duration of the contract, a meeting will be required and an action plan created and agreed to identify ways of preventing a re occurrence:

*More than 1 issue of more than 4 weeks duration,

*More than 2 issues of 2 weeks duration within 12 a month period.

In addition to offsetting all direct costs incurred by NHS Scotland during any period where product is unavailable, NSS reserves the right to request a 10 % credit on all purchases for a period of 3 months after the supply issue has been resolved. This is to offset the additional resource and activity required to manage the availability of replacement and/or alternative products needed to meet clinical requirements.

Any alternative products offered during supply shortages will be at no additional cost to NHS Scotland Health Boards.

15) Complaints - All Lots - Suppliers should confirm that, in the event an official complaint is received from National Procurement, that:

1. A containment response detailing similar complaints against the noted product will be provided within 10 working days of the complaint being communicated to your organisation.

2. A final investigative report will be provided within 30 working days of the complaint being communicated to your organisation.

Should an awarded supplier have:

More than 2 repetitive substantiated product complaints (e.g. confirmed manufacturing defect) within any 6-month period, or 3 distinct substantiated product quality complaints within 12 months.

The supplier will be required to provide details of all complaints they have received within their total market and the corrective actions identified to prevent re-occurrence, and provide appropriate evidence that actions have been implemented.

The Authority will notify economic operators who submitted a tender or (where no deselection process has previously been made) applied to be selected to tender, of its decision to award the Framework Agreement which notification will contain, among other information, a summary of the reasons as to why the economic operator was unsuccessful. The notification will incorporate a ‘standstill period’ of a minimum of 10 (ten) clear calendar days (or a minimum of 15 (fifteen) if the communication method used is not electronic) between the date on which the Authority despatches the notice(s) and the date on which the Authority proposes to conclude the relevant Framework Agreement. The bringing of court proceedings against the Authority during the standstill period will automatically continue the prohibition on entering into the Framework Agreement until the court proceedings are determined, discontinued or disposed of, or the court, by interim order, brings to an end the prohibition. The remedies that may be awarded by the courts before the Framework Agreement has been entered into include the setting aside of the decision to award the Framework Agreement to the winning tenderer(s). The bringing of court proceedings against the Authority after the Framework Agreement has been entered into will not affect the Framework Agreement unless grounds for the imposition of special penalties under the Public Contracts (Scotland) Regulations 2015 can be established. Otherwise the remedies that may be awarded by the courts where the Framework Agreement has been entered into are limited to the award of damages.
