II.2.4)Description of the procurement:

As per the short description, Perth & Kinross Council are seeking to invite passenger vehicle Operators to participate in a Dynamic Purchasing System (DPS) which will be used to procure transport related ‘service contracts’ operated by Public Service Vehicles (PSV).

Operators may join the DPS at any point during its validity if they satisfy the selection criteria and none of the grounds for exclusion apply.

Under the DPS, contracts awarded will be subject to a tendering process (i.e. mini-competition) with all Operators who have been admitted to the DPS being invited to tender. Contract awards may arise from the combination of more than one competition and the Council will seek to match offers which give the most economically advantageous result for the Council.

4A.2 Bidders must confirm that they hold a Public Service Vehicle Operator's Licence. A copy of the PSV Operator's Licence must be provided with the ESPD i.e. application to join the DPS. More detail on what is expected from Operators in response to the questions in section 4A.2 is detailed in the Instructions for Tenderers document.

4B.5.1 It is a requirement of this contract that bidders hold, or can commit to obtain prior to the commencement of any subsequently awarded contract, the types and levels of insurance indicated below:

Third Party Motor Insurance to comply with section 145 of the Road Traffic Act 1988 with a minimum Property Damage cover of 5 000 000 GBP on an each and every claim basis.

General Public Liability Insurance (as distinct from Third Party Motor Insurance) with a minimum cover of 5 000 000 GBP on an each and every claim basis.

Employer's Liability Insurance (if employees are engaged by the Contractor with a minimum cover of 10 000 000 GBP on an each and every claim basis.

Under the DPS, mini-competition tenders will be evaluated to identify which of the eligible tenders will deliver best value for money for the organisation. This will be based on Quality and Price criteria, typically in the proportion of Quality 10:Price 90. This ratio may be varied for individual competitions under the DPS.

Quality criteria will be linked to the subject matter of the contract and be based on the operational delivery of particular elements outlined in the specification.

The Quality criteria will be more precisely formulated at the tender stage and may be varied for individual competitions under the DPS.

The Contracting Authority does not intend to include a sub-contract clause as part of community benefits (as per Section 25 of the Procurement Reform (Scotland) Act 2014) in this contract for the following reason:
