II.2.4)Description of the procurement:

The Forestry Commission intend to award a Framework Agreement for The Supply of Mechanised Tree Harvesters and Forwarders including associated Parts for service and repair with delivery across Scotland and England.

The duration of the Framework Agreement shall be for 3 years plus an option to extend for a further 1 year at our discretion and will be based on the following factors: performance of Machines, budget availability, value for money and delivery to specification.

The value of the Framework Agreement has been estimated at no more than 11 000 000 GBP excluding VAT, split approximately 68 %/32 % between Scotland and England.

The Forestry Commission anticipates appointing a minimum of 3 and a maximum of 5 of the top ranked bidders to the Framework Agreement that comply with the requirements of this tender.

- This multi-supplier framework agreement was not split into Lots, either geographically or by product as all bidders will be expected to deliver to both countries and maintaining 2 lots for the same requirement would introduce an unreasonable complexity to the contracting authority.

ESPD evaluation will be scored as pass/fail. Should any question be subject to pass/fail scoring be scored ‘fail’ the entire bid shall be set aside and shall take no further part in the competition.

- Where the bidder relies on the capacities of other entities/consortium member in order to meet the selection criteria they must provide a separate ESPD for each entity. Please read the bidders instructions on the ESPD section 2C.1 for full details.

If the bidder intends to subcontract any share of the contract to third parties, then the bidder will be required to submit a separate ESPD (Part II A&B, and Part III A&B only) for each subcontractor.

Where changes are made with the agreement of the FC Framework Manager during the period of the Framework Agreement to the other entities that the bidder relies on in order to meet the selection criteria they must provide a separate ESPD for each new/replacement member to the FC Framework Manager.

The ESPD will be reviewed by the FC to determine the appropriateness of the new/replacement member. The FC's decision on whether or not to allow the change/addition will be final.

- The FC shall be entitled to award a contract (max 3 year) following the Negotiated Procedure to allow an extension of the supply of Parts for Machines from a specific Supplier (manufacturer) where any other Part would result in incompatibility or disproportionate technical difficulties in operation and maintenance (Public Contracts Scotland Regulations 2015,33.3.b).

- Bidders should note that although the value has been estimated at up to 11 000 000 GBP the FC may modify the Framework Agreement, irrespective of the monetary value of those modifications, within the scope permitted as allowed under Regulation 72 (1) of The Public Contracts Scotland Regulations 2015, should Operational reasons require it.

Actual requirements can vary due to changes in (for example):

1) Catastrophic Machine failure,

2) Policy Change.
