Precise information on deadline(s) for lodging appeals: The Contracting Authority will incorporate a standstill period of a minimum of ten calender days from the date that information on the award of the contract is communicated to tenderers. This period will allow unsuccessful tenderers to challenge the proposed contract award before the contract is entered into. Any such challenge should be intimated to the address specified in Part 1.1 If a challenge regarding the award of contract has not been succcessfully resolved, the Public Contracts (Scotland) Regulations 2006 as amended provide for aggrieved parties who have been harmed or who are at risk of harm by a breach of the rules to take action in the Sheriff Court or Court of Session. Any such action must be brought within three months (other than proceedings seeking an Ineffectiveness Order which must be brought within 30 days of the relevant date) of the date on which the unsuccessful tender knew or ought to have known, of the alleged infringement of the procurement rules. Where a contract has not been entered into the Court may order the setting aside of the award decision or order the Councils to amend any document and may award damages. If the contract has been entered into, the court may only award damages. The purpose of the standstill period referred to above is to allow parties to apply to the courts to set aside award decisions before the contract is entered into.
