The works can be provided only by a particular operator for reasons that are connected with the protection of exclusive rights (i.e. ownership of the site).
The Council is in the process of delivering new affordable housing throughout Fife and these acquisitions of new houses are part of that programme. The Kelty area has a high need for affordable housing. The Council has carried out market research into this area, including a publically advertised market engagement exercise, and this site was identified as the only option immediately available to the Council in the Kelty area.
This contract is for the construction and subsequent acquisition by the Council of 58 new houses. The Council has had a significant influence on the design/specification of those houses; to the extent that the contract may well be considered to be a public works contract.
The site is owned by Persimmon Homes.
The Council considers that as the site is owned by Persimmon Homes, and there is no other site available to it to alleviate the pressure for affordable housing in this area, this contract can only be awarded to this particular operator and is, therefore, using the Negotiated Procedure without prior publication of a contract notice.
